ARTIST'S RESALE RIGHTS

Conditions of Sale - Vendors

Unless stated otherwise sales will be held on the dates published; starting at 10.00 am and are subject to the following conditions;

GOODS/ARTICLES ENTERED FOR SALE

We reserve the right to be selective and to refuse any goods/articles without reason. In addition, we will refuse any item(s) which have an unrealistic reserve price.

All goods/articles are left entirely at the owner’s risk. Any insurance requirements are a matter for the owner. Whilst on our premises the goods/articles are not insured. Goods/articles are only accepted on the basis that they will not be offered for sale elsewhere while they are on our premises.

The description of Lots in the catalogue will be that of the Vendor not Orpington Sale Rooms.

Orpington Sale Rooms Ltd or any of it’s staff shall not be held responsible for any goods/articles received or stored by us.

If the goods/articles fail to sell they will be entered into the next sale at our discretion, unless instructions are received to the contrary. This will be at half of the original reserve; or with no reserve if the original reserve was £15 or less. Goods/articles will not normally be entered for a third sale. Goods/articles remaining unsold after two auction entries are to be removed by the Vendor by close of business on the Friday following the auction, after this a storage charge will be made. Goods not removed within three weeks will be auctioned without a reserve price and any storage charge due deducted accordingly. All Goods/Articles remain the property of the Vendor until the hammer falls and the item is sold, and may be withdrawn from the auction at any time. However, Lots withdrawn or reserve prices increased after the catalogue has been compiled will be subject to an administration charge.

If an offer of the Reserve Price is made on unsold goods/articles within 24 hours of the end of the auction the offer will be accepted. Vendors who do not wish their goods/articles to be included must make this fact known. If an offer is made at less than the reserve price, the vendor’s agreement will be required before acceptance. Sales of this nature will remain subject to the normal rates of commission.

VENDOR ACCOUNTS

Settlement

Vendor accounts will be settled in accordance with the instructions on the ‘Client Registration Form’. Cheques will only be sent on request to the address given and will not be issued for amounts of less than £50. Cash from sold lots can be collected from 1pm on the Friday following the Sale. Cash accounts will not be posted. Cash will be held for three(3) months from the Sale date after which it will be donated to charity without any further reference to the vendor.

Vendor accounts that exceed £750.00 (net) will not be settled until Orpington Sale Rooms Ltd has received cleared funds from the Buyer(s). Should cleared funds not be received within 5 working days of the Sale, settlement will be made LESS the monies outstanding; the balance being paid immediately cleared funds are received.

CHARGES

 The following charges are payable;

 Commission:

             Hammer Price up to £3                                             £0.50 Plus VAT

 Hammer Price £4 or more                                        15% of the Hammer Price (min £1) (plus VAT)

 Withdrawn Lots or Increase in Reserve Price:        £5 per Lot

             Storage Charge:                                                         £5 per Uncollected Lot per day or part thereof

Artist’s Re-Sale Rights


From February 2006 living artists are entitled to receive a re-sale royalty each time their artwork is bought or sold by an art market professional. This new law was introduced in the UK following a European directive. Works sold for a sum of 1000 euros (approximately £680) or more will be subject to the following additional charge as per the scale rate shown below. This will be charged to the vendor of any eligible Lots and will be based on the hammer price. This charge does not incur VAT and is in addition to the commission & VAT. The exchange rate used to determine whether or not Artist’s Re-Sale Rights apply and the rate at which they apply with be the Bank of England exchange rate at 10.00am on the day of the Sale

 COMMISSION AND VAT IS PAYABLE ON ALL GOODS/ARTICLES SOLD WHILST ON THESE PREMISES.

 A signature on the ‘Client Registration Form’ acknowledges that these conditions are understood and are agreed.
